UPDATE (3/30/16): The Court granted Final Approval to the Settlement on July 29, 2014. Appeals were filed on August 27, 2014 and September 9, 2014. One of the appeals was dismissed on December 18, 2014.
After considering the second appeal, the U.S. Court of Appeals for the Seventh Circuit issued an order affirming the Settlement on March 25, 2016. Barring further proceedings, the Settlement will become final on June 23, 2016 and we expect that checks will begin mailing to Class Members who filed valid claims in early July.
Option B and Option C claim payments cannot be mailed until a Medicare/Medicaid lien release is obtained. If you have received a form requesting information from you related to this release and have not returned it, please do so as soon as possible. Please contact us if you have any questions regarding this release or need another copy of your form.
If there are further proceedings, no claims can be paid until after those proceedings are resolved and the Settlement becomes final. This website will be updated as soon as more information becomes available.
Welcome to the official website regarding the settlement of a class action filed against Unilever United States, Inc. ("Unilever") and two other companies (collectively, "Defendants") and arising out of the purchase or use of the Suave® Professionals Keratin Infusion 30-Day Smoothing Kit ("Smoothing Kit") in the United States before February 17, 2014.
The Plaintiffs allege that Unilever misled consumers into purchasing and using the Smoothing Kit by making false and misleading statements concerning the safety of the Smoothing Kit, and by failing to disclose that the Smoothing Kit posed an unreasonable risk of hair and/or scalp injury when used by consumers in accordance with the product warnings and instructions, or when misused by consumers in ways that were foreseeable. All Defendants deny that they did anything wrong and deny that the Smoothing Kit posed an unreasonable risk of harm to consumers.
The case was filed in the United States District Court for the Northern District of Illinois and is titled "Reid, et al. v. Unilever United States, Inc., et al.," Case No. 12 CV 6058 (the "Lawsuit"). Related cases were filed in the United States District Court for the Western District of Kentucky and the United States District Court for the Northern District of California. This website is maintained by the Settlement Administrator retained and supervised by the Parties and approved by the Court.
